The Legal Process

What is a limited work licence?

It is an exemption that allows a disqualified or suspended person to continue driving, typically for work-related purposes, medical reasons, or for transporting dependent’s. It comes with certain limitations that are specified in the court order.

The legal process

An application must be made to the Court, and an order must be granted by the Court before a work licence can be issued. The Court requires specific documents to be drafted and filed in order to process an application. The application will be reviewed by the Police and generally a brief court appearance is required by the applicant.

WHAT DOCUMENTS ARE REQUIRED FOR A LIMITED LICENCE APPLICATION?

Limited Licence Application Documents

Applicant Affidavit

This document is the core of your application, it details the legal requirements, and gives an explanation of your circumstances that justify your need to submit an application.

Employer Affidavit

An affidavit from your employer is required to support your application. This document confirms your work circumstances and your need to drive for work purposes.

Affidavit In Support

If you are self-employed, a contractor, or are the director of a limited liability company, a third-party affidavit in support needs to be submitted with your application.

Draft Court Order

This document states your driving terms and conditions whilst on a limited licence. A correctly formatted order saves the court time, ensuring the process moves quickly and smoothly.

Notice Of Application

This document serves as your official court application for the Limited Licence. It notifies the court of your intention to apply and outlines the grounds for your application.

Driving Boundary Map

A detailed boundary map is needed for your application, that clearly outlines the areas you are permitted to drive. This helps support your case and increases the likelihood of success in court.
